CCPA - California Consumer Privacy Act

If you live in California, this privacy policy applies to you. It applies to all website visitors and users of services who live in California ("consumers" or "you"). This notice is required by the California Consumer Privacy Act of 2018 (CCPA).

What We Collect At DesignAShirt

We collect various categories of personal information that can be associated with a particular consumer or device. The following list provides examples of the types of personal information that we may collect from California residents. Please note that the categories and examples below are those defined by the CCPA. It's important to note that not all examples from each category may have been collected by us. However, we believe that some information from each category may have been collected, to the best of our knowledge and in good faith. Additionally, certain categories of personal information may only be collected if you provide them directly to us.

Category A: Identifiers Examples: real name, alias, postal address, unique personal identifier, online identifier, Internet Protocol address, email address, account name, or similar identifiers.

Category B: California Customer Records personal information categories (Cal. Civ. Code  1798.80(e)) Examples: Name, address, telephone number, credit card number, debit card number, or any other financial information provided during a purchase or interaction with us via chat or phone. Some personal information in this category may overlap with other categories.

Category C: Protected classification characteristics under California or federal law If used as part of a user's design, personal information collected may include age, race, color, ancestry, national origin, citizenship, religion or creed, marital status, medical condition, physical or mental disability, sex, sexual orientation, veteran or military status.

Category D: Commercial Information Examples: Records and histories of products or services purchased or considered.

Category E: Biometric Information N/A

Category F: Internet or other similar network activity Examples: Site browsing history, search history, information related to a user's interaction with our site, the device they used, and how they navigated to us.

CCPA Rights for California Residents

  • Notice: Be informed about the personal data collected and its use.
  • Request: Ask for details on the collection, sale, and sharing of personal data.
  • Opt-out: Choose not to have personal data sold.
  • Delete: Request to have personal data deleted (exceptions apply).
  • Non-discrimination: Exercise rights without being treated unfairly.

Please note that personal information under the CCPA excludes publicly available information from government records, deidentified or aggregated consumer information, and information excluded from the CCPA's scope, such as health or medical information covered by HIPAA or CMIA, clinical trial data, and personal information covered by specific sector-specific privacy laws, including FRCA, GLBA, FIPA, and the Driver's Privacy Protection Act of 1994. When it comes to personal information, there are some things you should know. For instance, publicly available government records and deidentified or aggregated consumer information don't count. Additionally, certain types of personal information are excluded from the scope of the CCPA, such as health or medical information covered by HIPAA and CMIA or clinical trial data, as well as information covered by sector-specific privacy laws like the FRCA, GLBA, or FIPA, and the Driver's Privacy Protection Act of 1994.

At DesignAShirt, we get the categories of personal information listed above from a few different sources. We may get it directly from you when you complete our forms, make a purchase, or use our services. We may also get it indirectly from you by observing your actions on our website. We take your privacy seriously and want to be transparent about how we use your personal information. We may collect and use your information for various purposes that will help us operate, personalize, and improve our services. For example, we may use your information to respond to your inquiries, fulfill orders, and provide support. We also may use your information for marketing, advertising, and testing purposes. If necessary, we may disclose your information in response to law enforcement requests or to protect against malicious activity. As a consumer, you have the right to request that DesignAShirt deletes any personal information we collected from you, subject to certain exceptions. If we receive and confirm your verifiable consumer request, we will delete your personal information from our records, unless an exception applies. We may deny your deletion request if retaining the information is necessary for us or our service provider(s) to:

  • Complete the transaction for which we collected the personal information
  • Provide a good or service that you requested
  • Take actions reasonably anticipated within the context of our ongoing business relationship with you
  • Otherwise perform our contract with you
  • Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities
  • Debug products to identify and repair errors that impair existing intended functionality
  • Exercise free speech, ensure the right of another consumer to exercise their free speech rights, or exercise another right provided for by law
  • Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 et. seq.)
  • Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information's deletion may likely render impossible or seriously impair the research's achievement, if you previously provided informed consent
  • Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us
  • Comply with a legal obligation
  • Make other internal and lawful uses of that information that are compatible with the context in which you provided it

Exercising Access, Data Portability, and Deletion Rights

Only you or someone legally authorized to act on your behalf may make a verifiable consumer request related to your personal information. You may only make a verifiable consumer request for access or data portability twice within a 12-month period. Your verifiable consumer request must provide sufficient information to allow us to reasonably verify your identity and describe your request with sufficient detail to allow us to properly understand, evaluate, and respond to it. We will confirm receipt of your request and provide information about how we will process your request, including our verification process. We will endeavor to respond to a verifiable consumer request within thirty (30) days of its receipt. If we require more time, we will inform you of the reason and the extension period in writing, which may be up to an additional thirty (30) days. If you have an account with us, we will deliver our written response to that account. If you do not have an account with us, we will deliver our written response by mail or electronically, at your option. Any disclosures we provide will only cover the 12-month period preceding the verifiable consumer request's receipt. The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.

We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.
